This has led to some companies scaling back or quietly rebranding their diversity, equity, and inclusion initiatives, a trend that has been dubbed “rainbow-hushing.” However, many of these programs were originally implemented to address real issues of discrimination and promote diversity in the workplace. With the executive order threatening federal investigations for “illegal D.E.I.,” lawyers are scrambling to interpret its implications and companies are feeling uncertain about how to proceed. Despite the challenges, many experts believe that doing nothing about these issues is not a viable option from a legal standpoint.
